PROTOCOL for NOMINATIONS TO STATUTORY
BODIES
The Nedlac parties recognise the value of adequate
representation by various constituencies in a range of statutory
bodies. To coordinate these nominations, as well as to ensure the
timeous nomination of representatives to these bodies following
administrative procedure will be followed:
1. Existing statutory bodies:
1.1. The Nedlac secretariat will compile a comprehensive
register of statutory bodies that will include the following
information:
a) Current delegates.
b) Terms of office and expiry dates.
c) The responsible government department.
d) The statutory requirements for the appointment of
delegates.
1.2. The register will be made directly available to relevant
parties.
1.3. The relevant government department will table three-months
advance notice of the expiry date of a statutory body and request
nominations in good time.
1.4. In the event that the term of office of a body expires and
nominations are not received within 60-days of receipt of the
advance notice, to ensure that the work of statutory bodies
continues and its legal obligations are fulfilled the Minister may,
after consultation with the relevant social partners, extend the
term of office of the existing representatives for a limited term
in order to maintain the legal competence of the board, or appoint
new members to the board.
1.5. Where any of the social partners is aware of a vacancy on a
statutory body it may table the issue in Nedlac with a view to
having a formal procedure initiated whereby the vacancy will be
filled.
2. New statutory bodies:
2.1. The nomination of representatives to newly established
statutory bodies will be dealt with as and when such bodies are
established.
2.2. The relevant government department will give three-months
advance notice of the establishment of new statutory bodies and
will simultaneously request nominations from Nedlac.
2.3. In the event that nominations are not received within
60-days of the advance notice, to ensure that the work of the
statutory body commences and its legal obligations are fulfilled
the Minister may after consultation with the relevant social
partners, appoint persons to the board.
2.4. New statutory bodies will be added to the register.
