SCHEDULE 9 OF THE LABOUR RELATIONS ACT
In a bid to make bargaining councils more accommodating of the
concerns of small, micro and medium-sized enterprises (SMMEs), the
Labour Relations Act states that a bargaining council agreement
must provide for the establishment of an independent exemptions
board in order for the Minister of Labour to extend the agreement
to non-parties. The Act also states that when appointing members to
these exemptions boards, bargaining councils must pay due regard to
the nominations made by the SMME-linked institutions listed in
schedule 9 of the Act.
It was agreed in Nedlac on 17 October 1996 that the Ntsika
Enterprise Promotion Agency and the Centre for Small Business
Promotion should be listed in schedule 9.
