NUCLEAR ENERGY BILLS TABLED AT
NEDLAC
The Department of Minerals and Energy have tabled two draft
bills at the National Economic Development and Labour Council.
These are the Draft Nuclear Energy Bill and the Draft National
Nuclear Regulator Bill.
A sub-committee has been established which will report to the
Trade and Industry Chamber. The lead negotiators from each of the
constituencies will meet tomorrow to look at the revised deadlines
and programme for the discussions.
Also tabled at Nedlac this week was a Section 77 notice
concerning the state of the criminal courts. The Federation of
Unions of SA(FEDUSA) tabled a notice in terms of Section 77(1)(b)
of the Labour Relations Act stating the reasons for and nature of
the protest action. They said they intended protesting because of
the poor state of the criminal courts, poor working conditions and
excessive demands being placed on public prosecutors. The notice
indicates that they intendlaunching a public awareness campaign and
pickets before, during and after work, as well as during rest
periods.
According to the act, once a registered trade union or trade
union federation has served notice on Nedlac stating the reasons
for andt he nature of the intended protest action, Nedlac is
required to consider this notice with a view to resolving the
matter through a process of facilitation. Nedlac has sent a
letterto the Minister of Justice requesting that he make himself
available for a meeting with Fedusa.
Nedlac has also received two new demarcation applications.
Demarcation determines which companies are grouped together in an
industryor sector for bargaining purposes. The LRA gives Nedlac the
task of considering applications to register new council or to
change the scope of existing ones. Anapplication was received for
the variation of the scope of the bargaining council for the
furniture manufacturing industry of the Eastern Cape. The other
application received by Nedlac is for the registration of an
amalgamating bargaining council for the meat trade in Gauteng.
