NEGOTIATIONS ON THE DRAFT LABOUR RELATIONS
BILL

The Nedlac trilateral negotiations on the draft labour relations
bill continued on Tuesday, Wednesday and Thursday, 11 to 13 July,
at the Carlton Hotel. The Nedlac secretariat will circulate a
report on the proceedings and agreements concluded to the
constituencies on Friday, 14 July, for consideration by the Nedlac
Executive Council meeting of Monday, 17 July.
The trilateral meeting has reached agreed conclusions on the
following core issues in the bill:
- Centralised bargaining.
- Closed shops.
- Strike ballots.
- Agriculture as a non-essential service.
- The establishment of bargaining councils.
- Disclosure of information.
- Organisational rights.
- Socio-economic strikes.
These agreements are to be referred for drafting before
inclusion in the bill.
Consensus was also reached on a number of other non-core issues
in the bill, which include:
- To scrap the 5% collection fee for trade-union subscriptions
[section 12 (5) of the bill].
- The governing body of the commission [section 112]. It will
consist of a chairperson and nine other members nominated by Nedlac
and appointed by the Minister.
It was agreed to establish a technical committee to:
- Consider the matters of picketing, temporary replacement labour
and lockout.
